These Terms and Conditions ("Terms") govern use of danamarkee.com (the "Website"). They apply to the Website only and do not govern clinical services, which are covered by separate informed-consent documents and by our Privacy Policy & Notice of Privacy Practices.
1. Acceptance of Terms
Use of the Website constitutes agreement to these Terms. If you do not agree, do not use the Website.
These Terms apply only to use of the Website and do not govern clinical or therapeutic services.
2. Informational Purpose Only
The content on this Website is provided for informational and educational purposes only. It is not medical, psychological, psychiatric, or counseling advice and is not a substitute for professional care, diagnosis, or treatment. Always seek the advice of a qualified provider about any condition.
3. No Therapist–Client Relationship
Use of the Website — including submitting a contact form, requesting a consultation, or sending a message — does not create a therapist–client relationship. A therapeutic relationship is established only after completing intake procedures, mutual agreement to provide services, and signing informed-consent documents.
4. Emergency Resources

12. Privacy
Use of the Website is also governed by the Practice's Privacy Policy & Notice of Privacy Practices, available at [link]. Website forms, email, and text may not be encrypted; do not submit sensitive clinical or health information through those channels.
13. Communications
Text and email communications are opt-in and are never a condition of treatment. Reply STOP to opt out of texts and HELP for help. Electronic communications may not be encrypted and are not monitored in real time for emergencies.
14. Minors
The Website is not directed to children under 13, and information is not knowingly collected from children under 13 online. Clinical services to minors are governed by separate consent documents and by California and Colorado law.
15. Telehealth and Multi-State Notice
Services are provided only to clients physically located in a state where the provider is licensed (currently California or Colorado) at the time of service, unless licensure requirements are otherwise met. The Website is informational and does not offer services in other states.
16. Governing Law and Venue
A. Website terms. These Terms, and any dispute arising from or relating to use of the Website, are governed by the laws of the State of California, without regard to conflict-of-law principles. Such disputes are subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles, CA.
B. Clinical services (dual-state information). These Terms do not govern clinical services. Because the Practice is licensed in both California (LMFT 164611; LPCC 23538) and Colorado (LPC.0024592), the law applicable to clinical services may depend on the client's physical location at the time of service:
Clients located in California: California law applies, including the Confidentiality of Medical Information Act (CMIA); the psychotherapist–patient privilege (Evidence Code §§ 1010 et seq.); the duty to protect (Civil Code § 43.92); and mandatory reporting (Penal Code § 11166; Welfare & Institutions Code § 15630).
Clients located in Colorado: Colorado law applies, including the Mental Health Practice Act (C.R.S. Title 12, Article 245) and its confidentiality-of-communications provisions; privilege (C.R.S. § 13-90-107); the duty to warn/protect (C.R.S. § 13-21-117); and mandatory reporting (C.R.S. § 19-3-304; § 18-6.5-108).
Where the laws of both states could apply, the stricter protection controls.
Regulatory complaints may be filed with the Board of Behavioral Sciences (BBS) in California, or the Division of Professions and Occupations (DORA) in Colorado.
17. Severability
If any provision of these Terms is found unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Changes to These Terms
These Terms may be updated at any time. Changes are effective when posted on this page with an updated effective date. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
19. Entire Agreement
These Terms, together with the Privacy Policy & Notice of Privacy Practices and any other legal notices on the Website, constitute the entire agreement regarding use of the Website.
